Abstract^:Ifpartiesapplyforexcludingillegalconfessionwhilethejudgehasn^’tstartedthe

exclusionprocedureyet^,orhasdecidednottoexcludetheconfession^,partiesstillhavetheright

toputforwardcausesforapplicationtorefutetheprobativeforce.Thestandardofexcludingcon-

fession^,testimonyandvictimstatementshouldbethesameone^,thatis^,whethertheillegalact

ofcollectingevidencesmakespeopleconfessagainsttheirfreewill.Ifprocuratorialorgansexclude

confessionintheprocessofreviewoftheindictmentandinterrogatesuspectsagain^,theymust

ensuresuspectsmakevoluntaryconfession.Judgesmustn^’tignoretheinformationbeneficialto

theaccusedintheexcludedrepeatedconfession.Confessionnoteshavelittlevalueinprovingthe

legalityofcollectingevidences^,andtheaccordanceofconfessionnotescan^’tbetheindicationof

legality.Incaseswithmanydefendants^,eachdefendanthastherighttoapplyforexcludingother

defendant^’sconfessionnomatterthatconfessionisagainsthimornot.
