    国际贸易中的反倾销及其立法行为已经存在上百年历史，尤其是最近二十年来，世界各国不仅纷纷立法或完善本国的反倾销规定，而且在世界范围内掀起的反倾销浪潮一浪高过一浪。究其理论根源在于倾销有罪，而倾销罪过的经济学原理在于“价格歧视”。但是，价格歧视并非反倾销成立的合理理由，反倾销理论与实践是背离的。因此，探寻价格歧视的本意，是认定反倾销是否合理的关键。

英文摘要：
    Antidumping and its legislation in international trade have a history of more than 100 years. Recent 20 years especially witnesses its legislation or its regulationperfecting in various countries and a worldwide surge of its employment in practice. Its theoretical source traces back to dumping being guilty, while the economic principle of dumpingguilt lies in the guilt of “pricediscrimination”. This article holds that pricediscrimination is not a rational reason for antidumping, its theory and practice deviate from each other, and therefore, inquiry about the original intention of pricediscrimination is the key to a determination of antidumping rationality.
